At another court hearing on December 2, Mayor Stoyan Dulev testified before the Pazardzhik District Court in his capacity as a defendant in a criminal case. The charge was brought on the occasion of the August 2004 settlement. contract for waste disposal with Beev and Beev. Then Stoyan Dulev was acting mayor and as such was accused of causing serious material damage to the municipality. The main damage was not done to the municipality of Velingrad, but to the municipal company Stroycom and therefore the action for charges is logical to be brought by Stroycom, pleaded the prosecution on December 2 and changed the charge against Mr. Dulev. Until now, the paradoxical situation existed for the municipality to sue the mayor of the municipality. Now, however, a new paradox is emerging because Stroycom cannot be constituted as a party in the course of the case.
In his testimony before the court, the defendant pointed out that he had signed a contract with Beev and Beev, as this was economically beneficial for the municipality. According to him, the private firm was cleaning for 54,000 leva per month and the municipal one for 76,000 leva per month, and had to rent additional equipment from Beev and Beev. Whether this is the case will have to prove the court-appointed accounting expertise. It will also have to show how much the municipality owed to each of the two companies at the request of the Prosecutor's Office. At the request of Dulev's defense, the difference in the monthly payment to the two companies will have to be established.
The main question to Stoyan Dulev was why he signed the contract with Beev and Beev with a pre-execution clause, which is included only in strictly defined by law emergencies. The defendant indicated that he did so on the advice of the municipality's legal counsel and the chief accountant and for the sake of economic benefit. The prosecution did not take this as a sufficient justification as there was no emergency.
Another important question to the accused was how and why "Beev and Beev" used dumpsters, which are owned by "Stroycom" and so the municipal company was caused damages of over 10 000 leva. According to Stoyan Dulev, he did not sign any document authorizing the use of the containers and did not know on the basis of what this was happening.
The case will continue on January 9 next year, when the required economic expertise is to be presented.
