The elections in Sarnitsa - a novel with sequels

From the 19th century dates the practice of publishing novels with sequels in newspapers. Even then, authors and publishers discovered the universal formula of how to make the reader shudder in anticipation of what the fates of the main characters would be. It gives an excellent result so far, creatively recreated in the mile long Latino and Hollywood series. Life is never late to repeat art. Examples many, and another is the case with the mayoral elections of Sarnitsa. We have already informed you that on March 19 the Municipal Election Commission announced the elected mayor of Sarnitsa Shukri Yakubov. This was on the basis of a final decision of the Supreme Administrative Court, preceded by a 5-month odyssey that went through the trials of 7 court cases heard by different chambers of the District and Supreme Court. After the issuance of the certificate by the OIC at the session of the Municipal Council on March 22, Shukri Yakubov had to be sworn in as Mayor of Sarnitsa and take office for his second term. However, the script turned out to be different. First, the chairman of the Municipal Council, Nejat Kehayov, informed the councillors that he had been corresponding with the Central Election Commission for the local elections (CECMI) all morning, which had requested cassation in the elections in Sarnica, but lost the case in the Supreme Court. The CECMI has received a complaint from DPS candidate-mayor in Sarnitsa Recep Kisyov against the decision of the OIC by which Sh. Yakubov. In this situation, it is better to postpone the swearing-in, urged Mr. Kehayov, supported by DPS-advisor Recep Sijim, who said that R. Kisyov should be mayor.
There is no case that is subject to debate, there is a decision of the Supreme Court and the OIC as the only body that has the power to declare who is elected mayor, opposes Dr. Dafov. Eck. Cafferinova reminded the councillors that they were all sworn in also after a decision of the legitimate body - the OIC and that the Municipal Council could not vote on whether to take the oath. She stressed that the issue is becoming very political and that an attempt is being made to circumvent the law. This is a precedent, OIC certificates are not papers, Asim Adem said. Zavarin Marov expressed doubts that the case was not clear, recalled also how Fidel Beev did not take oath after a decision of the OIC. Another recall was necessary: Mr Beev was not sworn in because the court suspended the decision of the OIC with a definition, and the case in Sarnitsa is different - the court issued a decision on the basis of which the OIC announced who is the mayor.
The councillors also argued whether the complaint lodged by R. Kisyov suspended the implementation of the OIC's decision, as well as whether Mr. Kisyov was a party to the latest case in the Supreme Court between the CECMI and the SC. Yakubov. The latter read before the councilors the entire decision of the SAC that the elections in Sarnitsa were actual and it concerns only a technical error in a protocol of a sectional commission. Boryana Belukhova asked for a lawyer to attend, but according to Nejat Kehayov all lawyers refused to interpret, and OIC chairwoman Miliana Shuleva resigned.
I am not contesting the oath-taking, but not in a hurry, insisted N. Kehayov. In turn, Sh. Yakubov said he would refer the prosecution to N. Kehayov for using official position to his detriment. The degree in the hall became so high that Chairman N. Kehayov gave a non-statutory rest, during which he held another consultation.
After the break, he announced that the district government had also advised him to wait so as not to get into a bigger mess. A group of Sarnitsa does everything, if no oath is taken, it will be a tort, insisted Dr. Dafov. Eventually, Nejat Kehayov resorted to the guillotine of the vote, proposing that Shukri Yakubov's oath be postponed. This well-oiled political tool worked: 13 councilors from the DPS, BSP and the Green Party made the unique decision from a legal point of view. On March 22, Sh. Yakubov did not take office as mayor (paradoxically, but if he had not been sworn in as a municipal councilor after the elections, Mr. Yakubov would have continued to be mayor of Sarnitsa all the time). For her part, the next on the UDF list Atanaska Hrischeva could not be sworn in as an adviser, although there is such a decision of the OIC.
All week it was waiting for the CECMI to rule on the case in Sarnitsa again. In the Central Election Commission, however, they are not in a hurry - their meeting of 24 March went unanswered to the question whether the decision of the OIC - Velingrad is illegal. A new meeting will be held on 30 March, Monday, and R. Kisyov has also filed an appeal with the District Court - that is, the carousel can start again from the starting position.
There is nothing left but to take advantage of the old tried-and-tested formula: "Continues in the next issue".
