He was accused by the District Prosecutor's Office that, as a person of responsible office, he intentionally committed an act with significant harmful public consequences. The reason is the concluded by St. Dulev contract for the garbage disposal of the municipality with the company "Beev and Beev". In violation of the public procurement law, the contract was signed with the so-called "pre-implementation", and in addition, Dulev exceeded his rights as a vrid mayor, as he did not request permission from the Municipal Council for the use of garbage containers. In the read indictment, the prosecution stressed that despite the decisions of the Pazardzhik District Court (POC) and the Supreme Administrative Court (SAC), that Beev and Beev did not meet the conditions and should not participate in the ranking, Stoyan Dulev had concluded a contract with the company with enviable speed. The defendant stated that he did not plead guilty and wished to testify after hearing all the witnesses.
First before the court stood as a witness the former deputy mayor and chairman of the commission that held the competition for cleanliness, Recep Hodzhov. To a large part of the questions he answered with "I don't remember" - why was the offer of "Beev and Beev" preferred to that of the municipal company "Stroycom", were the members of the commission familiar with the decisions of the SAC and did the company "Beev and Beev" have the right to participate in the competition, how long the competition lasted and how the protocol was prepared so quickly that hours after that a contract was signed. Asked who had been cleaning Velingrad since August, Mr. Hodzhov replied that on the streets where he passes, he was cleaning "Beev and Beev".
12 municipal councilors from the 17 who reported to the prosecution last year on the actions of Vrid Mayor Dulev also stood in front of the court. They were unanimous in their answers that because of the contract signed by the then mayor in the municipality created a heavy environment, Stroycom was on the verge of bankruptcy, the municipal budget suffered great damage. The councillors argued their decision not to provide the bins for rent to Beev and Beev in that they would legitimize the contract, which they consider illegal. Stoyan Dulev appeared as a liquidator of the municipal company, did not implement the decisions of the session, lied to the councilors that the municipality does not pay either of the two companies, and at the same time, only "Beev and Beev" was paid behind the back of the Municipal Council. The private company also received money for landscaping, provided that only Stroycom did landscaping activities during this period.
The five members of the competition committee were also questioned. It turned out that of them only M. Nikolova has experience, everyone else has participated in such a procedure for the first time. They did not familiarize themselves with all the decisions of the SAC, and the huge tender documentation of 4 companies was reviewed within only 2-3 hours. Everyone declared that they were not pressured to choose "Beev and Beev". No one has asked themselves the question of whose ownership are the garbage containers and how will care for the cleanliness firm that does not have them. The judge in the case entered into a legal dispute with the lawyer of the municipality Vladimir Despotsky, who also learned about the decision of the SAC after the competition. We are jurists, we should obey the laws, not circumvent them, the judge advised him. The chief accountant of the municipality Hristo Savov explained that they work with documents and paid only to Beev and Beev, and the appointed for investment control S. Bayraktar stated that he was not aware that Stroycom had cleaned. Testimony was also given by former Stroycom manager Tanya Goncheva and current Toshko Kyutov, who said that the municipality had not yet paid the company the 223,750 leva due from August to November. The case will continue on October 7, when, at the insistence of the prosecution, statements are called to give the exec Dr. Tsvetan Dafov and the manager of the company Krasimir Beev. The court requires the municipality and a number of references, an expert will also be heard.
