The case against Dulev was postponed "by illness"

A sudden illness of Stoyan Dulev's lawyer and a hospital diagnosed with Krasimir Beev's menial syndrome caused the criminal case against Mr. Dulev to be postponed from 7 to 17 October this year. In criminal case 519/05 of the Pazardzhik District Court Stoyan Dulev was accused that as vrid mayor of the municipality of Velingrad in August 2004. has entered into a contract with Beev and Beev and has thus caused serious property damage to the municipality. The charge was raised by the District Prosecutor's Office on the signal of municipal councilors from Velingrad, who gave testimony at the previous hearing in the case on July 14, 2005.
For the meeting on October 7 as witnesses were called Dr. Tsvetan Dafov, during whose term as mayor the procedure of the public procurement for the cleanliness and the employee in OA Diana Barakova was started. They will testify before the court on October 17, when the already absent Krasimir Beev, whose signature is under the contract with Stoyan Dulev, must come to the hall. The decision on October 7 not to proceed with the case was made after hearing the parties. District Attorney Ivan Daskalov was of the opinion not to give a move, as the defendant Dulev does not have a defender. Stoyan Dulev said that he wanted his lawyer to be present at the interviews of the witnesses. Lawyer Totev, who appeared on behalf of the Municipality of Velingrad, asked for the trial to be launched. He announced that on behalf of the Municipality of Velingrad he is asking under art. 154 of the NK Stoyan Dulev to be removed from the post of mayor of the municipality for intentional crime until the conclusion of the court proceedings in the case. Judge Parpulova announced that there was no such request from the prosecution and that she could not rule, as the case was underway. She adjourned the session until October 17, having previously imposed a fine of 500 leva for failing to appear for the defendant's lawyer, for which a hospital sheet was not even presented. After the hearing, lawyer Totev explained to journalists the motives to request the temporary removal of Stoyan Dulev from the mayoral post. According to the lawyer, the paradoxical hypothesis is that Stoyan Dulev as mayor of the municipality on the one hand is a civil claimant in the case, and on the other hand is a defendant in the same case. (There is also an opportunity, in his capacity as mayor, for Mr. Dulev to simply withdraw the claim of the municipality in this case, and in other cases, which the municipality has filed with a claim for the financial compensation against Beev and Beev).
By law, the request for the temporary removal of a mayor from office can be submitted by the prosecution and then considered in a closed court session.
