Expectedly on September 13, the interim mayor Stoyan Dulev did not appear due to illness and the District Court postponed the case for his removal from office by a decision of the Municipal Council, suspended by mer Hamza as acting regional governor.
The court examined the case of the second decision suspended by Mr. Hamza - on the election of Ivan Lebanov as interim mayor. As evidence, the lawyer of the district government presented a hospital list to the district governor Yves. Dimitrov for the period 16 August - 10 September, released on 20 August. The lawyer of the Municipal Council N. Bozhilov pointed out that the order signed by Mr. Hamza to suspend the election of Yves. Lebanov is illegal. It was signed with a comma on August 19 and Mr. Dimitrov's hospital was issued on August 20. Lawyer Bozhilov developed before the court the thesis that the powers of the legally elected mayor Fidel Beev were not terminated by an effective decision. A certificate from the Municipal Electoral Commission was presented that a legal dispute was still ongoing over the decision to remove him. Therefore, Mr. Bozhilov pointed out that the situation under Art. 42, para. 2 of the LMSMA and no qualified majority is needed for the election of Ivan Lebanov. The opposite was the opinion of the lawyer of the District Government, and the prosecutor in the case supported her. The two argued that, under the law, councillors are required to elect a deputy mayor as interim mayor. The court also heard Mr. Lebanov, who said that he considered the order of the district government to be unlawful and the Municipal Council was entitled to elect an interim mayor. The Trial Chamber has one month to rule.
