The court again suspended the mayor's oath

On February 14, the Municipal Election Commission (OIC) handed over the election protocols to the Central Commission for Local Elections (CECMI) in Sofia. However, the protocol was not adopted by the CECMI because it did not explicitly state what the dissenting opinion of 9 of the 11 members of the OIC was. This forced the OIC to re-fill the protocol, with the nine signatories with a dissenting opinion arguing for the presence of ballots not responding to the approved template. No opinion whatsoever, they signed A. Achev from the quota of ODS and M. Dzhivgov from the DPS; the representatives of the NDSV, BSP, UDF and BSD have signed a dissenting opinion. On February 15, the documentation was again submitted to the CECMI and accepted.
In the early afternoon of the same day, the chairwoman of the OIC, Ivanka Stancheva, officially handed the certificate to the newly elected mayor of the municipality of Velingrad, Fidel Beev. Mr. Beev received the document in the presence of his cronies and minutes after that announced that he would run for MP in the parliamentary elections in June this year. He did not specify with which party he would participate in the elections for the National Assembly, but said that the winners all invited them.
Shortly after, Atanas Vodev filed an official complaint against the decision of the OIC to announce F. Beev elected mayor of the municipality of Velingrad. The complaint lists violations of the electoral law and requests suspension of the OIC's appealed decision on the grounds that the execution of the decision would result in a gross violation of public interests. On February 16, 10 municipal councilors (4 from the Green Party, 3 from the BZNS, 2 from the DPS and 1 from the BSP) submitted a request to schedule a session of the local parliament to take the oath of office F. Beev. The Bureau of Operations complied with the 7-day scheduling deadline required by law and set the date February 23. The first item on the agenda was the swearing-in of the newly elected mayor.
On February 17, new dramatic twists occurred: after a fax from the regional governor Ivan Dimitrov, the session at which F. Beev to be sworn in, was withdrawn for 10 hours on February 18. But minutes before the end of the working day February 17, a three-member panel of the Pazardzhik District Court, chaired by Penka Yaneva, determined that it was suspending the decision of the Municipal Election Commission to announce Fidel Beev as elected mayor of the municipality of Velingrad. The Court finds that the execution of the judgment must be suspended in order to avoid undesirable negative consequences, since the act under attack is of great public importance and concerns a large number of people. The order issued by the POS is not subject to appeal.
In the presence of a court order, the session of which F. Beev was supposed to be sworn in as mayor, it didn't happen. On Monday, February 21, in the Pazardzhik District Court started the case on the appeal of Atanas Vodev (selections in the next issue). Whatever the decision of this instance, it can also be appealed in the Supreme Administrative Court. At the head of the Municipality of Velingrad as temporary mayor while the case is ongoing and not dropped the definition remains the interim mayor Atanas Vodev.
